These Terms of Service (“Terms”) govern your access to and use of the Pretty in Biz Consulting LLC website, forms, digital resources, products, scheduling tools, and other online services made available by Pretty in Biz Consulting LLC (“Pretty in Biz,” “we,” “us,” or “our”).

By accessing our website, submitting information through our website, scheduling an appointment, purchasing a digital product, or otherwise using our online services, you agree to these Terms.

If you enter into a separate proposal, service agreement, engagement agreement, statement of work, or other written agreement with Pretty in Biz, that agreement governs the professional services covered by it. If there is a conflict between these Terms and a separately executed agreement concerning those professional services, the separately executed agreement will control for that engagement.

1. ABOUT PRETTY IN BIZ

At Pretty in Biz Consulting LLC, we provide accounting, bookkeeping, financial strategy, advisory, event financial management, financial education, digital tools, and related business financial services and resources.

Services may include, depending on the applicable engagement:

  • Monthly bookkeeping

  • Bookkeeping cleanup

  • Catch-up bookkeeping

  • Accounting-system setup and financial foundation services

  • Financial diagnostics

  • Event financial management

  • Financial strategy and advisory services

  • Nightlife CFO / advisory services

  • Financial planning and analysis related to business or event operations

  • Digital financial tools and resources

  • Other related services agreed to in writing

Not every service is appropriate for every business. Submission of a form, completion of a qualification questionnaire, or communication with Pretty in Biz does not guarantee acceptance as a client or eligibility for a particular service.

2. WEBSITE INFORMATION

Information provided through the Pretty in Biz website, social media, emails, educational content, digital resources, or other general communications is provided for general informational and educational purposes unless specifically delivered as part of an agreed professional engagement.

General website or educational information does not, by itself, create an accountant-client, advisory, or other professional relationship.

A professional engagement begins only when Pretty in Biz and the client complete the applicable engagement process, which may include an executed agreement and required payment.

3. PROFESSIONAL SERVICES

The specific scope, deliverables, responsibilities, fees, payment schedule, duration, termination provisions, and other terms applicable to professional services will be stated in the proposal, agreement, engagement documentation, or other written terms applicable to that service.

Pretty in Biz is entitled to rely on information, records, explanations, documents, and system access supplied or authorized by the client.

Unless specifically included in writing within the scope of an engagement, Pretty in Biz is not responsible for independently auditing or verifying the authenticity, completeness, or accuracy of information supplied by a client or third party.

Pretty in Biz may request additional documentation, clarification, system access, or other information reasonably necessary to perform an engagement.

Delays in providing requested information, documentation, approvals, responses, or system access may affect service timelines and Pretty in Biz's ability to complete work.

4. CLIENT RESPONSIBILITIES

Clients are responsible for:

  • Providing accurate and complete information

  • Providing requested records and documentation

  • Maintaining appropriate access to required systems

  • Responding to reasonable requests within requested timeframes

  • Reviewing information and deliverables provided to them

  • Informing Pretty in Biz of material changes affecting the engagement

  • Making final business and financial decisions

  • Maintaining their own business records as appropriate

  • Complying with applicable laws, filing requirements, payment obligations, and deadlines that remain the client's responsibility

Pretty in Biz is not responsible for consequences caused by inaccurate, incomplete, withheld, altered, late, or inaccessible information supplied by or on behalf of a client.

5. TAX AND LEGAL MATTERS

Pretty in Biz may provide accounting services and financial information that relate to taxes, tax planning considerations, estimated tax calculations, financial reporting, or business decision-making when included within the applicable scope of service.

However, Pretty in Biz does not provide legal services or legal advice.

Unless expressly included in a written engagement, Pretty in Biz is not engaged to provide tax-return preparation, legal opinions, legal representation, audits, attest services, or other services outside the agreed scope.

Clients should consult an appropriately qualified attorney, tax professional, or other specialist when their circumstances require services outside Pretty in Biz's engagement.

6. FINANCIAL ANALYSIS, FORECASTS, AND PROJECTIONS

Certain services, digital resources, or deliverables may include budgets, forecasts, scenarios, break-even calculations, profitability analyses, financial models, estimates, or other forward-looking information.

These analyses are based on assumptions and information available at the time they are prepared.

Actual business or event results may differ because of changes in revenue, expenses, attendance, pricing, market conditions, client decisions, vendor performance, operational conditions, or other factors.

Pretty in Biz does not guarantee any particular revenue, profit, savings, tax result, business outcome, event result, or financial performance.

7. FEES AND PAYMENT

Prices displayed on the website apply only to the product or service identified with that price and are subject to the terms presented at the time of purchase.

Professional-service fees may instead be established through a proposal, service agreement, engagement agreement, invoice, payment schedule, or other written documentation.

You agree to pay all amounts you authorize according to the applicable purchase or engagement terms.

Failure to make required payments may result in delayed work, suspension of services, withholding of deliverables where legally permitted, cancellation, or termination in accordance with the applicable agreement.

8. REFUNDS, CANCELLATIONS, AND TERMINATION

Refund, cancellation, and termination terms may differ depending on the product or service purchased.

Professional Services

Professional services are governed by the refund, cancellation, termination, deposit, and payment provisions contained in the applicable proposal or service agreement.

Where a separately executed agreement contains terms that differ from these website Terms, the separately executed agreement controls for that professional engagement.

Digital Products

Because downloadable digital products may be delivered or made accessible immediately after purchase, digital-product purchases are generally final and non-refundable once access or delivery has occurred, except where otherwise required by law or expressly stated at the time of purchase.

Appointments and Paid Assessments

Cancellation, rescheduling, credit, or refund terms applicable to a paid appointment, assessment, or diagnostic may be disclosed during booking or purchase and will govern that transaction.

Pretty in Biz may cancel or terminate access to a product or service in cases involving nonpayment, misuse, fraud, abusive conduct, unauthorized distribution of intellectual property, material breach of applicable terms, or other circumstances permitted by an applicable agreement or law.

Nothing in this section limits rights or remedies that cannot legally be waived.

9. DIGITAL PRODUCTS AND RESOURCES

Pretty in Biz may offer spreadsheets, planners, templates, guides, calculators, educational resources, or other downloadable or digital products.

Unless expressly stated otherwise:

  • Purchases provide a limited license for the purchaser's own personal or internal business use.

  • Products may not be resold, sublicensed, republished, distributed, copied for commercial distribution, or made available to others as a competing or derivative product.

  • Purchase does not transfer ownership of Pretty in Biz intellectual property.

  • Digital products are tools and resources and do not guarantee any particular business or financial result.

  • Purchasers are responsible for the information and assumptions they enter into a digital tool and for decisions made using its output.

10. INTELLECTUAL PROPERTY

The Pretty in Biz website and its original content, branding, designs, frameworks, tools, templates, spreadsheets, documents, written materials, graphics, downloads, and other proprietary materials are owned by Pretty in Biz Consulting LLC or used with appropriate permission and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not reproduce, distribute, sell, license, publish, modify, create commercial derivative works from, or otherwise exploit Pretty in Biz proprietary materials without prior written authorization.

Nothing in these Terms prevents a client from using client-specific deliverables for the internal business purposes for which those deliverables were created, subject to any additional provisions in the applicable service agreement.

11. THIRD-PARTY PLATFORMS AND SERVICES

Pretty in Biz uses third-party technology and service providers to support portions of our website, payments, scheduling, communications, accounting, client service, document management, and other operations.

Use of third-party platforms may also be subject to those providers' own terms and privacy policies.

Pretty in Biz is not responsible for outages, interruptions, security incidents, errors, changes, or other circumstances caused solely by third-party platforms outside Pretty in Biz's reasonable control.

12. WEBSITE AVAILABILITY AND SECURITY

We may modify, suspend, restrict, or discontinue portions of the website or online services at any time.

Although Pretty in Biz takes reasonable measures designed to protect its systems and information, no website, electronic transmission, or technology platform can be guaranteed to be completely secure or continuously available.

You agree not to misuse the website or attempt to interfere with its operation, security, or accessibility.

13. PROHIBITED USE

You may not use the Pretty in Biz website, forms, products, resources, or services to:

  • Engage in fraudulent or deceptive activity

14. SMS/TEXT MESSAGE TERMS

Pretty in Biz Consulting LLC may offer text-message communications to individuals who have separately provided appropriate consent.

Depending on the consent provided and the nature of your relationship with Pretty in Biz, messages may include appointment reminders, scheduling information, requested follow-up, purchase or account information, service-related communications, client communications, or other messages described when you opt in.

Consent to receive text messages is not a condition of purchasing services or submitting an inquiry.

Message frequency may vary. Message and data rates may apply.

You may cancel SMS messages at any time by replying STOP. After you send STOP, you may receive a confirmation that you have been unsubscribed.

After that, you will no longer receive messages covered by that opt-out unless you later provide consent again.

15. EMAIL COMMUNICATIONS

16. NO GUARANTEE OF RESULTS

Business and financial outcomes depend on numerous factors outside Pretty in Biz's control.

Pretty in Biz does not guarantee:

  • Increased revenue

  • Increased profitability

  • Cost savings

  • Tax savings

  • Funding or financing approval

  • Business growth

  • Event attendance

  • Event profitability

  • Specific financial outcomes

  • Any particular business result

Examples, scenarios, illustrations, or past experiences should not be interpreted as promises of future results.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pretty in Biz Consulting LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the website, digital products, general informational content, or circumstances outside Pretty in Biz's reasonable control.

Any limitations applicable to professional services are governed by the applicable service agreement in addition to applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

18. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Pretty in Biz Consulting LLC and its officers, employees, contractors, and representatives from third-party claims, losses, liabilities, damages, or reasonable expenses arising from your unlawful misuse of the website or digital products, your violation of these Terms, or your infringement of another person's rights.

Any indemnification obligations relating specifically to a professional engagement will be governed by the applicable service agreement.

19. PRIVACY

Your use of the website and online services is also subject to the Pretty in Biz Consulting LLC Privacy Policy.

The Privacy Policy explains how Pretty in Biz collects, uses, discloses, and protects personal and business information.

20. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent a dispute concerning these website Terms is not governed by a separate written agreement, any legal proceeding concerning these Terms will be subject to the jurisdiction of courts having appropriate jurisdiction in Broward County, Florida, unless applicable law requires otherwise.

Professional-service disputes remain subject to any mediation, venue, dispute-resolution, or other provisions contained in the applicable service agreement.

21. CHANGES TO THESE TERMS

Pretty in Biz may update these Terms from time to time to reflect changes in the business, website, products, services, technology, or applicable requirements.

Updated Terms will be posted on the website with a revised “Last Updated” date.

Changes will apply prospectively to use of the website and online services after the updated Terms become effective. Changes to an existing professional engagement will remain subject to the applicable agreement and applicable law.

22. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

23. ENTIRE WEBSITE TERMS

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the terms governing general use of the Pretty in Biz website and online services

They do not replace a separately executed proposal, service agreement, engagement agreement, or other contract governing professional services.
